The Law Offices of Thomas Wolpert, P.C. limits its practice of law to several areas, primarily: (i) business law and commercial litigation, including employment law; (ii) insurance law, particularly issues of insurance coverage and (iii) real estate, including representation of homeowners and condominium associations. A substantial part of our practice involves civil litigation, in federal and state court, arbitrations, administrative hearings, professional license hearings, jury trials, and mediations. Thomas Wolpert is licensed in Pennsylvania and New Jersey and we regularly represent Pennsylvania clients with respect to their New Jersey legal affairs within the practice areas identified above.
Within the category of business law, we draft and review business contracts and agreements, employment contracts, franchise and loan agreements, purchases and sales of businesses, and related transactional documents. We form limited liability companies and corporations and provide operating agreements. We litigate with respect to all manner of business conflicts, including: breach of contract, restrictive covenants, commercial debt collection, intellectual property disputes, and certain aspects of corporate law. We do some creditor side bankruptcy work.
Construction litigation is a regular part of our practice and we regularly represent contractors and construction professionals in construction disputes, which often take place under the auspices of the American Arbitration Association.
Within the employment law context, we regularly litigate employment contracts (especially for senior management or professional employees), professional license hearings, unemployment compensation, issues arising under the Wage Payment and Collection Law, and occasionally employment discrimination or matters arising under federal labor law statutes. We have litigated in the area of security clearance denials.
Within the category of real estate law, we review, draft and litigate homeowners' association and condominium documentation, commercial and residential agreements of sale, the acquisition of commercial property and commercial leases, zoning appeals, express and implied deed restrictions, etc. We represent clients with respect to sheriff's sales, foreclosures, tax sales and landlord-tenant matters.
With respect to insurance coverage, we handle insurance coverage issues pertaining to casualty insurance (which often overlaps with construction litigation), errors & omissions coverage, claims for employment benefits arising from workplace coverage (ERISA), and some automobile and homeowner coverage claims.
We also handle routine estate planning and estate administration manners, including estate litigation. We pride ourselves on candid advice at the outset of a matter, outlining the range of possible outcomes and the probable costs associated with achieving those outcomes. We work diligently to settle cases where settlement is possible and we litigate aggressively and efficiently where it is not (sometimes, but not always, aggressive and efficient litigation leads to a favorable settlement).
